SUMMARY

This PartsSource, Inc. Web Privacy Policy (“Web Privacy Policy”) applies to all of the websites, including but not limited to www.partssource.com, www.partsfinder.com, www.epartsfinder.com, https://supplier.partssource.com/, www.theremigroup.com, www.remionline.com, www.rox.theremigroup.com and www.naimaging.com, operated by PartsSource, Inc. (collectively, the “Sites”, and each, a “Site”) unless a different policy is provided on a particular Site, in which case such different policy shall control. PartsSource, Inc. (hereinafter referred to as “PartsSource”, “we” or “our” or “us”) wants you, the visitor to our Sites, to understand how we collect and use data about your visits to our Sites. This Web Privacy Policy identifies what information the Sites collect, and what it is used for. The Sites collect some “personally identifiable information,” which is information that identifies you. This may include your name, address, email address, telephone or fax number and certain other information, as explained in more detail below. We also use cookies and anonymous information, which we gather from the cookies and from your computer to help us monitor and improve the usage and performance of the Sites. We do not disclose this information to third parties for their marketing purposes, but we do use third-party software and services to assist us with analyzing information regarding use of the Sites. This Web Privacy Policy only covers information collected at the Sites, and does not cover any information collected at any other web site by us or any other related or unrelated company (unless specifically stated) or collected offline by us, unless specifically stated.

INFORMATION WE GATHER

We may collect two types of information through our Sites: anonymous information and personally identifiable information (“PII”). We collect certain anonymous data regarding the usage of the Sites. This information does not personally identify users, by itself or in combination with other information. We gather it to improve the performance of the Sites. We obtain the categories of PII listed above from the following categories of sources:

 

  • Directly from you. For example, when you:
    • register yourself with one of our Sites or services;
    • submit information or place an online order;
    • submit information through our helpdesk system;
    • subscribe to one of our e-newsletters;
    • participate in a promotion (e.g. a sweepstake or contest);
    • review or comment on one of our products; or
    • otherwise communicate with us, such as request information.
  • Indirectly from you. For example, through information we collect from you in the course of providing our services to you.
  • Directly and indirectly from activity on our Sites. For example, from Site usage details that are collected automatically. For more information on automatic information collection, please review the “Cookies” section below.

 

The information that you provide in each case will vary. In some cases, you may be able to provide PII via email or free text boxes, such as contacting us to request further information.  When providing your PII, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers, credit card information or other sensitive personal data, unless required for our services. Additionally, we may ask you to create a username and password that should only be known to you.  When you provide this information to us, you are no longer anonymous. In all such cases, you choose whether to provide us with the PII, but certain portions of the Sites may not be available to you if you do not provide the PII requested.

 

COOKIES

Cookies are small bits of data cached or stored on your computer based on Internet activity. We use cookies to monitor individual activity in aggregate to improve the Sites. Cookies are usually defined in one of two ways, and the Sites may use both of them:  (1) session cookies, which do not stay on your computer after you close your browser, and (2) persistent cookies, which remain on your computer until you delete them or they expire.  The information we gather through cookies includes your IP address, user language, the operating system, browser type, the presence/absence of “flash” plug-ins, your screen resolution, connection type and information that identifies the cookie. USE AND DISCLOSURE OF INFORMATION

We do not sell, trade or rent your PII collected on the Sites to any third party. We do not provide your PII to any third party for their own marketing purposes. The length of time we intend to retain PII is for as long as reasonably necessary to carry out our intended business purpose for such information. 

 

We use the information collected through the Sites for statistical purposes and for improving the Sites, as well as for our marketing purposes and potentially sending commercial emails to you. We often engage a third party’s software or services to assist us with these analyses. As a practical matter, we must release your mailing address, or other Identifiers (as detailed above), to a postal or courier service to deliver information you requested. We use third parties to assist us with our marketing efforts, including assisting us with sending emails to you or showing you ads for our products while you are visiting our Sites. This may include sending you free electronic newsletters and promotional emails for products and/or services offered on our Sites as a service. We may send you newsletters and emails periodically listing current specials and deals from us or through our third-party service partners. However, you will have the choice to opt out of receiving newsletters and promotional emails for our products and/or services by selecting the “unsubscribe” option at the bottom of the marketing communication.

 

We may also use and disclose, if required, PII in order to respond to a subpoena, court order or other such request, as necessary to enforce the Terms of Use of this Site and to address any problems or concerns we have regarding your use of this Site, and to notify you of changes to this Web Privacy Policy, our Terms of Use or other policies or terms that affect you and your use of our website. We may also provide such PII in response to a law enforcement agency’s request or as otherwise required by law. We reserve the right to disclose, share, assign and/or otherwise transfer your information, including without limitation PII, in connection with: (i) a filing for bankruptcy; or (ii) a whole or partial transfer of our assets or ownership in connection with proposed or consummated corporate reorganizations or restructuring, such as mergers, acquisitions, consolidations or sales of business units.

 

We may share PII, such as Identifiers (as detailed above) and anonymous information with entities that perform functions on our behalf. For example, and without limitation, we may share your information with entities that host the Sites, send communications on our behalf, analyze data, and provide customer service. These third parties may have access to your information, including PII, only to the extent it is necessary to perform their duties and functions, and subject to this Web Privacy Policy.

 

User Submitted Content:

Our Sites may permit users to submit or otherwise contribute content or display submitted information (e.g., testimonials). If you submit a comment, code, work of authorship, photograph or any other content to be published by us (either online or offline), you agree that we may publish your name or other PII in connection with publishing the content. This Web Privacy Policy does not apply to any information disclosed publicly in such forums, testimonials or other submissions. You should keep in mind that whenever you post or submit information about yourself for use in such forums, testimonials or other submissions, that information could be collected and used by people that you do not know. In addition, forums may display IP addresses and other testimonials and submissions may display PII along with the message poster’s name and message. We bear no responsibility for any action or policies of any third parties who collect any information disclosed in such forums or other public areas, if any, of the Sites.

 

Children:

The Sites are not directed at children and PartsSource does not knowingly collect any personally identifiable information from children under sixteen (16) years of age unless the collection complies with the Children’s Online Privacy Protection Act (“COPPA”). If you are under sixteen (16) years of age, do not send any information about yourself to PartsSource. If PartsSource discovers that a child under the age of 16 has provided PartsSource with PII, PartsSource will use commercially reasonable efforts to delete that child’s PII from its system.

 

YOUR RIGHTS UNDER STATE LAW

California.

  • Shine the Light Law.  Pursuant to California Civil Code Section § 1798.83, we will not disclose or share your personally identifiable information with third parties for the purposes of third-party marketing to you without your prior consent.
  • Do Not Track Signals.  Other than as disclosed in this Web Privacy Policy, the Sites do not track users over time and across third-party websites to provide targeted advertising.  Therefore, each of the Sites do not operate any differently when it receives Do Not Track (“DNT”) signals from your internet web browser.
  • WE DO NOT SELL OR SHARE YOUR PERSONAL INFORMATION. If we ever decide to “sell” or “share” PII, as those terms are defined under the California Consumer Privacy Act of 2018, we will update you via this Web Privacy Policy and include a link entitled “Do Not Sell or Share My Personal Information,” to provide you with an opportunity to opt out of the selling or sharing of your PII.

 

Your Consumer Rights.

Some states in the United States provide consumers with additional rights with respect to their personal information (also known as “personal data”), as those terms are defined under those applicable state laws. Such state laws may include, but are not limited to, the California Consumer Privacy Act of 2018 (the “CCPA”) as amended by the California Privacy Rights Act, the Colorado Privacy Act (“CPA”) and the Virginia Consumer Data Protection Act (“VCDPA”).  Any personal information we collect is collected for the commercial purpose of effectively providing our services to you, as well as enabling you to learn more about, and benefit from, our services. If you reside in a state that provides additional rights with respect to your personal information, you may exercise each of your rights as identified below, subject to our verification of your identity.  

 

  1. Access.  You have the right to request that we disclose certain information to you about our collection, use and disclosure of your personal information over the past twelve (12) months. Any disclosures we provide will only cover the 12-month period preceding the receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

 

  1. Correction.  You can correct what personal information our Site databases currently contain by accessing your account directly, or by contacting us to request that we correct or rectify any personal information that you have provided to us.

 

  1. Portability.  Upon request and when possible, we can provide you with copies of your personal information.  When such a request cannot be honored, we will advise you accordingly.  You can then choose to exercise any other rights under this Web Privacy Policy.

 

  1. Deletion.  You have the right to request that we delete any of your personal information, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.  Where applicable, we will ensure such changes are shared with trusted third parties.

 

  1. Opt-out of Processing. You have the right to request that we do not sell your personal information, use your personal information for targeted advertising, or use your personal information for profiling. Where applicable, we will ensure such changes are shared with trusted third parties.

 

  1. Non-Discrimination. If a data subject exercises his or her rights under applicable state law, including but not limited to the CCPA, CPA, and VCDPA, we shall not discriminate against that data subject by denying our goods or services, charging different prices or rates to similarly situated consumers, providing a different level or quality of our goods or services, or taking any other adverse action.

Responding to Your Request. Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the personal information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like for us to in fact delete your personal information before acting on your request.  We will respond to your request within forty-five (45) days. If we require more time, we will inform you of the reason and extension period in writing.

 

In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

 

FOR WEBSITE VISITORS IN THE EUROPEAN UNION (“EU”)
Under the General Data Protection Regulation (“GDPR”), individuals in the EU, and also in the United Kingdom, are afforded specific rights with respect to their Personal Information, or “personal data” as defined under the GDPR.  For the purposes of this Web Privacy Policy, we operate as a data controller.  Any personal data we collect from you is processed in the United States and under the terms of this Web Privacy Policy. 

 

Any personal data we collect from you is processed in the legitimate interest of our business and providing our services to you as the lawful means of such processing.  You may always withdraw your consent to our use of your personal data as described below.  We will only retain your personal data for the time necessary to provide you the information and services to which you have consented, to comply with the law and in accordance with your rights below.

  • Erasure. We are not responsible for the privacy policies of websites to which the Sites link. If you provide any information to such third parties, different rules regarding the collection and use of your personal information apply. We strongly suggest you review such third party’s privacy policies before providing any data to them. The privacy practices of those websites linked to our Site are not covered by this Web Privacy Policy. We are not responsible for the policies or practices of third parties. These other sites may send their own cookies or clear GIFs to users, collect data or solicit personally identifiable information. We cannot control this collection of information. TEXT MESSAGING

You may have the opportunity to receive SMS or "text" messages, pre-recorded voice messages or auto-dialed phone calls from us, our affiliates and related entities as well as third parties.  Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested.  In providing your mobile device number or cell phone number to us, you knowingly consent to such communications from us or for us to use your cell phone number or mobile device number.  In providing your number, you represent that you have the authority to agree to receive text messages at the telephone number that you provide to us, or from which you sent the text message request to us.  You further acknowledge that no purchase is required to opt into this service, and you may opt out at any time by following the instructions provided in our communications to you.

SECURITY

In any organization, failure to protect personal information can increase the risk of a privacy breach. These privacy breaches can lead to things such as reputational harm, fraud or identity theft.  We take steps to manage the privacy of your PII and the security of the Sites. We have implemented commercially reasonable measures designed to secure any information, both personally identifiable information and anonymous information, stored by the Sites against accidental loss and from unauthorized access, use, alteration, and disclosure.  For example, you may utilize a username and password to enjoy our Sites.  It is your responsibility to keep confidential your username and password.  Additionally, when we collect or transmit information over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.   However, we cannot guarantee the security of any information that is disclosed online. We make no warranty regarding the security of any information you transmit to us via the Sites and you do so at your own risk. If you believe your credentials have been compromised, please change your password. Please also notify us of any actual or suspected unauthorized use.
